On September 4, 2026, the EU adopted guidelines on applying Article 102 of the Treaty on European Union to “excessive exclusive conduct by enterprises in market dominance”. These guidelines aim to ensure that relevant provisions can effectively address modern business practices, promote compliance, and enhance consistency in implementation, in order to address the issue of exclusive conduct by enterprises in market dominance that deprives competitors of fair competition opportunities.
